Dear Sirs,

Kuwait Wataniya Airways (K.S.C.) apologizes to all clients due to abrupt suspension of its operations. This suspension was not deliberate or intentional; rather it was due to force majeure resulting from severe financial disorders and lack of cash liquidity that was threatening to attach all airplanes of the Wataniya Airways at foreign destinations where it reaches.

The resolution to suspend the operations in this abrupt manner was very difficult as it was related to the rights of our dear clients before any other parties associated with Wataniya Airways. Unfortunately Wataniya Airways had no other alternative under the above referred to circumstances that caused this resolution.

We would like to advise the passengers of Wataniya Airlines who booked the tickets from 16/03/2010 till 16/03/2011 and could not travel due to suspension of operations on 17/3/2011 that it has been decided to refund their air ticket value in accordance with the following mechanism and procedures:

First: Ticket holders who booked on Wataniya Airlines (via travel offices and agencies) and they could not travel on time:

Within one month from the date hereof Wataniya Airlines will refund all bookings to travel offices and agencies via International Air Transport Association (IATA). Therefore, Wataniya Airlines appeals the clients who booked their tickets from travel offices and agencies to approach these offices and agencies to refund the value of the air tickets effective from 31/01/2013

Second: Air ticket holders who directly booked their tickets on Wataniya Airlines and they could not travel on time:

Direct booking means that was made by the client via company's offices directly or via company's website (online). Refund formalities of these air tickets to this category of clients differ based on the action already taken by the client to claim for refund of air ticket value as follows:

1- Should the client has already filed a lawsuit against the company:

The company will refund air ticket value in full in addition to court fees, provided that the plaintiff must provide the company with copy of air tickets or the claim substantiated with the supporting documents on the email knainfo@yahoo.com

Within a maximum of one month from the date of receipt of the air tickets by the company and being verified to ascertain the validity of the claim, the value of the air tickets will be refunded to entitled parties in addition to judicial fees, provided that the plaintiff must submit a declaration authenticated by the Notary Public indicating his abandon of the lawsuit that was filed by him/her against the company

2- Should the client has already filed a complaint to Directorate General of Civil Aviation against the company:

The company will refund air ticket value in full, provided that the client must provide the company with copy of the complaint filed by him to Directorate General of Civil Aviation against the company accompanied with copy of the air tickets or the claim substantiated with the supporting documents on the email knainfo@yahoo.com

Within a maximum of one month from the date of receipt of the required documents and being verified to ascertain the validity of the claim, air ticket value will be refunded in full to entitled parties and then they will sign a declaration indicating abandonment of the complaint they submitted to Directorate General of Civil Aviation.

3- Should the client has already filed a lawsuit against the company or filed a complaint with Directorate General of Civil Aviation:

The company will refund air ticket value in full, provided that the client must provide the company with copy of the air tickets or claim substantiated with the supporting documents on the email knainfo@yahoo.com

Within a maximum of one month from the date of receipt of the required documents and being verified to ascertain the validity of the claim, air ticket value will be refunded in full to entitled parties and then they will affix their signature indicating collection of their rights.
